Use of Content

Among the information made available through the Comprehensive Collection Catalog Search System of the National Museum of Art, Independent Administrative Institution (hereinafter referred to as “the System”) (hereinafter referred to as the “Content”), Content that is indicated under Rights Statements as “No Copyright – Contractual Restrictions” (including content for which the copyright protection period has expired) may be used without special procedures, provided that all of the following conditions are satisfied. When using image Content that has been modified, the user must clearly indicate that such modification has been made.
In using image Content, users are requested to respect the moral rights of authors and to give due consideration so as not to harm the dignity of the creators or related parties.
Users must not use the Content in any manner that may impair the interests, public nature, or dignity of the National Museum of Art, or that may infringe upon human rights or other rights.
This usage rule does not apply to symbol marks, logos, or character designs representing organizations or specific businesses.

Copyright and Other Rights

Some of the Content made available through the System is subject to copyright or other rights held by third parties (meaning parties other than the National Museum of Art; the same applies hereinafter).
With respect to Content for which third parties hold copyright, or for which third parties hold rights other than copyright (such as portrait rights or publicity rights in photographs), users must, unless it is explicitly indicated that rights clearance has been completed, obtain permission for use from the relevant third parties at the user’s own responsibility. With regard to Content for which third parties hold rights, in some cases the existence of such rights is directly or indirectly indicated or suggested through source credits or other descriptions; however, in other cases, the specific portions for which third parties hold rights are not clearly identified or indicated. Users are responsible for confirming the status of such rights at their own discretion prior to use.

Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of Japan.
Any disputes concerning the use of the Content under these Terms or relating to these Terms shall be subject, as the exclusive agreed court of first instance, to the district court or summary court having jurisdiction over the location of the organization that publishes the relevant Content.

Disclaimer

The National Museum of Art shall bear no responsibility or liability whatsoever for any actions taken by users using the Content, including the use of information edited, processed, or otherwise modified from the Content.
The Content may be changed, relocated, or deleted without prior notice.
